1. Acceptance of Terms

2.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may deactivate your account at any time through your account settings or by contacting us. Upon termination, your right to use the Platform will immediately cease.

3. Platform Use and Conduct

3.1 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for your personal or professional purposes.

3.2 Prohibited Conduct

You agree not to:

• Use the Platform in any way that violates any applicable law or regulation
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Interfere with the proper functioning of the Platform
• Engage in any data mining, scraping, or similar data gathering activities
• Upload viruses or malicious code or engage in any activity that could disable, overburden, or impair the Platform
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Use the Platform to send unsolicited communications or promotions
• Harass, abuse, or harm another person or entity

4. User Content

4.1 Content Ownership

"User Content" refers to any text, images, videos, designs, portfolios, comments, and other materials that users upload, post, or otherwise make available on the Platform.

You retain all ownership rights to your User Content. By posting User Content on the Platform, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in any and all media or distribution methods now known or later developed, for the purposes of providing and promoting the Platform and our services.

4.2 Content Guidelines

You are solely responsible for your User Content. You agree that your User Content will comply with these Terms and will not:

• Infringe any patent, trademark, trade secret, copyright, or other intellectual property right
• Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, threatening, hateful, inflammatory, or otherwise objectionable
• Violate the legal rights (including the rights of publicity and privacy) of others

• Include false, misleading, or deceptive claims about your work or services
• Promote any illegal activity or advocate, promote, or assist any unlawful act

4.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we determine is otherwise offensive, harmful, or in violation of third-party rights, without prior notice. We also reserve the right to terminate access to the Platform for users who repeatedly post content that violates these Terms.

5. Professional Standards and Verification

ArchHub aims to promote professionalism and quality in the architecture and design community. While we may offer verification processes for professionals and firms, we do not guarantee the quality, capabilities, or credentials of any user.

Users who represent themselves as architecture professionals or firms must:

• Comply with all applicable professional licensing and registration requirements
• Accurately represent their qualifications, experience, and services
• Adhere to ethical standards of their profession
• Disclose any limitations in their practice or service capabilities

6. Intellectual Property Rights

6.1 Platform Content

The Platform and its original content (excluding User Content), features, and functionality are owned by ArchHub and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2 Trademarks

"ArchHub" and related logos, product and service names are trademarks of ArchHub. You may not use such marks without our prior written permission.

7. Payment Terms

We may offer paid services, subscriptions, or premium features on the Platform. By purchasing such services, you agree to the following:

• You will provide current, complete, and accurate purchase and account information
• You authorize us to charge your chosen payment method for the services you select
• If we are unable to charge your payment method, we may suspend or terminate your access to the paid services
• Prices and available services are subject to change without notice
• Subscriptions will automatically renew unless canceled before the renewal date
• Refunds will be issued in accordance with our refund policy

8. Third-Party Links and Services

The Platform may contain links to third-party websites or services that are not owned or controlled by ArchHub. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

9. Limitation of Liability

To the maximum extent permitted by law, ArchHub and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Platform
• Any conduct or content of any third party on the Platform
• Any content obtained from the Platform
• Unauthorized access, use, or alteration of your transmissions or content

10. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. ArchHub and its affiliates, officers, employees, agents, partners, and licensors expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that the Platform will meet your requirements, be available on an uninterrupted, secure, or error-free basis, or that defects will be corrected.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Platform shall first be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be submitted to binding arbitration in New York, New York, in accordance with the rules of the American Arbitration Association.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Platform, shall constitute the entire agreement between you and ArchHub concerning the Platform.

12.2 Severability

If any provision of these Terms is deemed invalid, unlawful, or unenforceable, the provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

12.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of ArchHub.
